General Terms and Conditions Russian Fine Art

Application

These general terms and conditions apply to all services and agreements made between clients, students, third parties and RFA. Deviations from these terms and conditions are only valid if they have been agreed in writing prior to the provision of the service. Applicability of any general terms and conditions or other conditions of the client is rejected.

Definitions

RFA: Russian Fine Art is a company that carries out various activities around the work of Russian artists in the EU. This includes the sale of paintings, the organisation of events with Russian artists and providing courses, trainings, and masterclasses by these artists. Participants: participants in courses, trainings, and master classes. Master class: on-site activity in which students receive education and training from top artists. Artist: the top artist selected by RFA and invited to teach the course, training or master class. Program: the program set up by top artists for course, training or master class. Course: a short course on one or more subjects for students. RFA services: all master classes, courses, trainings, etc. offered by RFA., here also called master class. Force majeure: abnormal and unforeseeable circumstances which are independent of the will of the person invoking them and the consequences of which, despite all precautions, could not be avoided.

Creation

An agreement for a master class is established after:
(1) the registration form on the website has been filled by the potential student, having read this general condition and agreed with this general terms and conditions and
(2) RFA has approved this registration, after that RFA sends an invoice to the potential student and
(3) the student has transferred the full amount of the invoice to RFA’s account
RFA has the right to refuse people to participate in this Masterclass without giving reasons. In case the group is full
RFA will provide to the potential student a proposal for an alternative date.
Registration is only possible via the digital registration form on the RFA website.

Cost

The price for the services of RFA is listed on the RFA website and excluded VAT. The price indicated on the website is per 1 (one) person. The price includes all program components as indicated on this website. The price does not include all the travel costs for the return trip to the location and all other additional costs that are not included in the program. The student will have to have cash or cards to pay for extra services, dinners and drinks. RFA takes all the costs included in the program, such as hotel, course materials, models etc. at her expense, all other matters and additional costs will have to be paid by the students their self in the place.

Payment

The payment of the invoice for the services of RFA have to be fulfilled beforehand. All the bookings will not be made by RFA until full payment of the invoice has been received on the account of RFA. As long as the payment has not been received by RFA the registration will not be final and the student will not participate in the program. Payment can be made via the options indicated on the invoice. All other payment options are excluded.

Refund and cancellation

After the payment of the invoice, the student can withdraw his/her registration no later than 2 months before the start date of the master class. The amount paid will be refunded by RFA minus an administrative fee of 10% of the total invoice amount. After this time refunds will not be possible under any circumstances. The student is allowed to allow a replacement to participate in the master class in case RFA accept this replacement. If RFA cannot hold the master class, RFA will refund the entire invoice amount to the student. Also RFA will then be able to offer the student a new date of master class.

Insurance

The master class locates in Italy or another EU country. The student must have a travel insurance which starts on the day of travel to the location of the master class and ends on the day of return home. This travel insurance must include at least all medical expenses, repatriation costs, liability, and luggage insurance.

Liability, accidents, damage, and misconduct.

RFA is not liable for student accidents, robberies, thefts of student property or damage to student property during the master class and the round trip. RFA is also not responsible for damage caused by students to hotels and visited institutions, materials used or otherwise. The student will have to insure himself against this because RFA will recover all damage caused by the student at the expense of the student. Students are responsible for their actions and can be excluded from the masterclass by RFA if they do not behave like a good guest and/or do not follow the instructions of RFA. Students may deviate from the program if, in the opinion of RFA and the artist, this does not have negative consequences for the master class or other students. Additional costs for this deviation are always carried by the student. If the student engages in criminal activities during the master class, the student will not only be excluded from the master class by RFA, RFA will also make a complaint to the local police. The student is responsible for complying with the applicable laws and regulations of the location. In case of removal the student from the master class, RFA will not refund the payment for the course. On the other hand, RFA will recover from the student any additional costs caused by misconduct from the student and the costs of removing the student from the master class.

Responsibilities of the student

The master class is meant to learn in an inspiring environment under the guidance of a top artist. It is expected that all participants actively contribute into this.

Responsibilities of RFA

RFA provides the master class according to the program on this website. RFA is free to make changes if due to aspects beyond its reach (Force Majeure) the program cannot be followed. The program can be adapted by the artist as he sees fit if the goal of the master class is achieved in a better way. This will be discussed with the students, but the artist always has the last word.

Photo and video materials

All the photos or video films taken during the master class will be used by RFA for their own promotion on the website and in the leaflets. Unless students have not objected to this before the start of the master class, RFA does not need permission for use in its own promotion. The artist who gives the master class can also use these photo and video materials for his own promotion without permission. For all other purposes these photo and video materials will not be used and will never be shared with other parties.

Travel documents and vaccinations

The student is responsible for the correct travel documents (passport, green pass, necessary tests and driving license etc.). If the student gets problems at the location because the papers are not in order, RFA is never responsible for this.

People with disabilities

RFA ensures that the master class is conducted in a location where disabled people can also come. However, it is mandatory for students to indicate in the registration form whether they have restrictions or special diets. RFA is not responsible for finding solutions to restrictions, wishes or diets that have not been previously announced to RFA.

Complaints

If a student has a complaint, it should be submitted to RFA as soon as possible. This can be done in any way, but it is preferable to notify by e-mail. RFA will make every effort to consider the complaint as soon as possible and try to find a solution. If a solution for student and RFA is acceptable, it will be executed. If the student rejects all the solutions proposed by RFA and does not contribute to a solution acceptable to all parties, the RFA is free to implement a solution of its own. Complaints submitted more than half a year after the end date of the master class will no longer be considered unless RFA decides otherwise.

Disputes

If a dispute arises between the student and RFA, the first attempt will be made to resolve this by mutual agreement. These general terms and conditions are always the guiding principle. If the dispute cannot be resolved satisfactorily by mutual agreement, both parties may use an independent third party to reach an agreement. Arbitration is always excluded. All agreements with RFA are exclusively regulated by German law. The decision of all disputes arising from the agreements mentioned under these terms and conditions shall be assigned to the competent German court.
